TERMS OF SERVICE

We’ll always do our best to fulfil your needs and meet your expectations, but it’s important to have things written down so that we both know what’s what, who should do what and when, and what will happen if something goes wrong.

In this terms of service, you won’t find any complicated legal terms or long passages of unreadable text. We’ve no desire to trick you into agreeing to something that you might later regret. What we do want is what’s best for both parties, now and in the future.

1. OUR SERVICE & RESPONSIBILITIES

 

We seek to provide a quality service from start to finish.  As part of this, we aim to keep in touch with regular updates about the progress of your throughout an active build project, and give you as much warning as possible of any potential delays.

We will provide all of the services selected within Section 1: Project Outline of your project contract for the fixed “build fee” indicated.

 

Please be aware our services do not include any form of formal marketing or business advice.  Super Simple Websites will not be held responsible for any results from the advice provided.

 

1.1 Renewal of Core Care Package
Our core care package leaves us responsible for providing several aspects of your website service, creating a seamless and hassle free experience for clients.  Your care package can be upgraded to provide additional support including site edits with any of our support packages here

Our core care package is collected via Direct Debit, and includes where relevant:

  • Domain Name Management - including renewal of your web address (domain) each year.
  • Website Hosting & SSL - storage and accessibility of  your website accessible on the web.
  • Backups - daily backups available for restoration in case of site error or accidental deletion
  • Email Forwarding - forwarding business emails to a relevant existing address. 
  • Plugins - Where additional licensed plugins or resources are required (e.g. additional product fields), we will renew the plugin on your behalf, and the renewal will be added to your core care package.
  • Updates and essential maintenance
  • Support and Consultancy - we can continue to provide advice and support on any future work or upgrades with a fixed quote approach.  Alternatively, monthly retainer packages are available to add-on for ongoing work.

Payment for our core care package is taken via direct debit, with your first payment due within two weeks of launch.  The basic core care fee does not cover changes or updates to content, products, images, videos, the appearance of your website or anything else outside the elements detailed above.   Such work will incur an additional fee available on enquiry. 

 

1.2 Domain Name Management

Unless otherwise arranged, Super Simple Websites will register and manage your domain name (website address).  However, we respect the this domain name is/are your asset(s), and Super Simple Websites acts only to manage your domain as directed by you. We do not claim ownership of any domains.

In this role, we will:

  • Apply DNS changes to your domain as requested within 5 working days of request.
  • Release your domain for transfer to an alternative registrar within 5 working days of request.
  • Renew your domain on your behalf annually

We will alter ownership details on any domain to your own details on request and provide direct DNS access.  Please be aware this process is reliant on your timely responses to admin and information requested.  

Domains can also remain with existing or elected registrars by arrangement. In this case, Super Simple Websites takes no responsibility for the renewal or management of the domain.  This is solely the responsibility of the client.

 

Where changes are requested to the DNS, or the domain is moved to an alternative registrar, we are not responsible for any issues that may arise with your website or other related services.

In the unlikely event of Super Simple Websites having to cease trading, you will be given management access via email.  This will allow you to transfer the domain to a seperate account, allowing you to take over management of the domain, or pass on to a new supplier.

Limitation of liability regarding domain name management
Domain names are registered via our agency account and while all necessary precautions are taken, Super Simple Websites can not be held responsible for any data or asset loss.

 

Super Simple Websites shall not be liable for any interruptions or damages caused by service outages, technical issues, asset loss, renewal failures or and other circumstances beyond Provider's reasonable control.

 

To the extent permitted by applicable law, we shall not be liable for any indirect, consequential, incidental, or special damages arising out of or in connection with the use of the domain name services.

 

1.3 Website Hosting & Backups
We host sites via a trusted supplier for all of our client sites. All sites are hosted on a UK Based server.

To streamline our support services as part of your ongoing relationship with Super Simple Websites, we do not build sites for use on alternative hosting except in unique circumstances by arrangement. 

Limitation of liability regarding hosting management
To the fullest extent permitted by law, under no circumstances and under no legal theory, whether tort (including negligence), contract, or otherwise, shall Super Simple Websites or any other contributor or supplier of Super Simple Websites, be liable to any person for any compensation or indirect, special, incidental, or consequential damages of any kind including, without limitation, damages for loss of goodwill, work stoppage, interruption of the services, technical failure or malfunction, data loss, or any and all other commercial damages or losses, even if such party shall have been informed of the possibility of such damages. You further understand and agree that while every reasonable precautions shall be undertaken by Super Simple Websites, we are not /shall not be responsible for any loss or damage incurred by you, including but not limited to loss or damage as a result of:

  • Any changes to the Services made by Super Simple Websites or relevant supplier(s),  or any temporary or permanent cessation in the provision of the Services (or any features within the Services),
  • The deletion of, corruption of, or failure to store, any content and other data maintained or transmitted by or through use of service,
  • Interruption of services, malware (including viruses and/or Trojans) and/or other errors over which Super Simple Websites and related suppliers have no control,
  • Any third party services and/or content of any kind. You understand that any hyperlinks to third party websites shall be regulated by the terms and conditions of third parties and that access to/use of such third party website shall be at your own risk.

 

1.4 Email Services

If we manage your domain name, Super Simple Websites can provide a range of email services, including

  • Email Account Creation - an account with its own “inbox” and “outbox”
  • Email Forwarding - email sent to [email protected] is forwarded onto an existing email address

Where we create accounts, any associates of Super Simple Websites will only access email data in a support capacity with awareness and permission from the account user.  We strongly encourage you to regularly change your password.

While every necessary precaution is taken to safeguard data, Super Simple Websites will not be held responsible for any damages resulting from data loss or technical failure.  We encourage all clients to back up their emails regularly.

Where we create an email forward, we are unable to view any emails delivered via the forward.

1.5 Requesting amendments to any services

Only requests from active directors, owners, management or employees of client companies will be actioned on any assets we manage on your behalf.  This includes, but is not limited to: domains, email accounts, social media profiles, digital artwork or assets, web design, plugins and hosting.  Where we are uncertain of an individual's authority on a client project, we will seek approval from a known associate on any action requested.

 

2. CLIENT RESPONSIBILITIES


2.1 Build process, approval and launch

Throughout the process, we will be in regular contact and give you multiple opportunities to input on designs and functions. We promise, nothing will become “live” without indication of your final approval.

We expect that any copy, imagery, fonts or other assets supplied by you have full permission for commercial use.

 

2.2 Failure to provide content

In order to maintain timeline, we require that content and feedback will be provided in a timely and organised manner, circumstances permitting, to avoid delays.

Where a client has failed to provide feedback or content requested over a four week period, Super Simple Websites reserves the right to consider the project canceled.  In this case, our cancellation policy is applied and full payment of the build fee will be due.

 

2.3 Editing your own website
Upon launch, you have full admin control of the website.  We will not accept responsibility for any future infringements or fines incurred resulting from content supplied by you, or uploaded by yourself at a later date.    Similarly, we will not source, upload or host any material which is, but not limited to; illegal, defamatory, slanderous or otherwise considered offensive or inappropriate.   Should your website be found in breach of this, your service will be suspended immediately without notice or refund.

Resources provided by Super Simple Websites - such as (but not limited to) images or vector graphics may be licensed.  Do not reproduce these elements outwith your website, or attempt to claim copyright or trademarks on any resources.  Super Simple Websites will not be held responsible for any fines or damages for your use of licensed content, and reserves the right to recover any related costs from yourself should they be incurred.


We will also not take responsibility for any errors, data loss or downtime following edits by yourself.  We will provide a quote for remedial work where requested.  As part of your arrangement with us, you acknowledge that Super Simple Websites will remain your key contact for ongoing support and consultancy requests.

 

3. PAYMENT TERMS, TIMELINES & CANCELLATIONS

 

3.1 Payment Method
Payments can be made via bank transfer (details supplied), or via online payment links supplied as required.  Core care package renewals are completed via Direct Debit by our payment partner, GoCardless.  Your homepage draft is completely free of charge and obligation.  Payment of your deposit is considered as complete agreement to the terms of your project contract and these terms of service.  Work will not proceed beyond your homepage draft before deposit payment.

 

 

3.2 Payment Timelines

Upon launch and handover of your site, your balance invoice and direct debit link for core care package are due within 14 days.  Where a client fails to complete both their balance payment and direct debit link within 14 days, services may be stopped and a £45 admin fee will be applied.


3.3 Project Cancellations
We hope you don’t find yourself having to cancel, but we understand things may happen outwith your control.  We’ve tried to make our cancellation policy as clear and fair as possible on both clients and ourselves.

3.4 Core Care Renewal Cancellations
Again, we hope for a long and happy relationship between Super Simple Websites and your business, however we understand your situation may change. 

Your core care package is paid on a monthly rolling basis.  You are welcome to cancel your package at any point - although please ensure you give us at least 5 days notice before your renewal date.  (e.g. if your renewal date is 15th October, your deadline to give notice is the 10th October).  Your services will be stopped 30 days after your last payment.

Where core care packages are cancelled but you wish to keep your website, please be aware you will then be responsible for renewing your services including domain name renewal, hosting and will be responsible for arranging your own licenses for plugins, themes or assets where required.

4.  AGREEMENT

You understand the conditions in your project contract and these terms of service, and will indicate your complete acceptance by payment of the project deposit.  We reserve the right to update our terms of service at any time.
